The U.S. insurance industry is exceptionally profitable, powerful and relatively free from anti-trust laws. The lack of regulation, combined with the high profit margin of the insurance business, has made it difficult for policyholders to exert their rights when they are denied their due coverage.

However, there are certain remedies for the policyholders – both individuals and corporations – when they do not receive the benefits that they are entitled to under their insurance policies. In those cases, policyholders have a right to file a “bad faith” action against an insurance company.

Insurance policies are legally binding contracts between and individual and the insurance carrier. The carrier has a legal responsibility to interpret the language of these contracts such that any ambiguity is resolved in favor of the insured, even if it may be in the best financial interest of the insurer to deny benefits under the contract. Failure to do so can constitute a bad faith denial.
